I see alot of people are either contractors for companies or have their own small companies

Suggest you go check the laws and Bargaining councils, you'll be in for a shock, JUST LIKE I WAS !

In a NutShell

if you employ staff and fall within the "range" of any bargaining council you gonna join them, whether you want to or not (and there are MANY of them)
in the LRA there is a piece about how to register a bargaining council, this gets followed and ANYONE can register a bargaining council, they follow the criteria, create their own rules and requirements AND IT GETS SIGNED INTO LAW, once your industry has a bargaining council the RULES OF THE BASIC CONDITIONS OF EMPLOYMENT ACT DON'T APPLY ANYMORE, it is now THEIR RULES.

Once that happens they can and will approach ANY company that falls under their "rules", with a very simple statement, JOIN OR ...

I told them to get lost when they told me that I WILL REGISTER with them, ALL MY STAFF AND MY COMPANY WILL PAY THE LEVIES, I will register ALL MY STAFF FOR THEIR PENSION FUND, I will register ALL MY STAFF for a few other levies, I WILL PAY ALL MY STAFF ANNUAL BONUSSES.

I had a "meeting" with them and an Independant Arbitrator today, almost got my way out of it, but they fight for their right to TELL YOU HOW TO RUN YOUR BUSINESS.

If you are a 1man business they can't do anything, BUT HAVE 1 STAFFMEMBER and you have to join, whether the staff member wants to or not, YOU MUST JOIN.

Another thing, THEY DECIDE YOUR STAFFS ANNUAL INCREASES for you, you don't have a say about that anymore either, they handle everything for you when it comes to money, staff and your business, including strikes and everything else.

Basically you create a business, you employ staff, and THEY DECIDE HOW TO SPEND YOUR MONEY FOR YOU !

Thanks for the explanation, Neil!

What a load of :cens! They are making it so difficult for a person to run an honest business! They are the reason that there are so much corruption in this country. Damn, so if I understand correctly, you now have to pay them (levy), so that they can tell you when and how much you must pay your people? No wonder that the unemployment rate is so high! Then "they" can also organise a strike and your people have to take part in it, leaving them without pay and you without output?

Maybe I am going to get :censfor this, but I think that a union that organise a strike is guilty of treason. They are directly responsible for negative growth in the economy etc. Look at the recent strike by the truck drivers. They brought the whole transport system to a stand still (and yes I know that was the idea) costing the government millions. Then you get the clever okes that will set fire to a train, because the carriages are in a poor state. :doh

Sorry for the hi-jack, Neil.

No hijack,
and then there is ofcourse their minimum salary scales, which is much higher than the minimum salaries we are used to.

You pay the guy that cleans the place about R 3000 / month ...

I have to move him from one CC to the other because he doesn't just wipe up dust, their is also "fibreglass" in the dust, THEREFORE HE WORKS WITH FIBREGLASS ...

Amazing !

hi neil

my staff compliment bounces between 70 and 120 people, depending on how much work i have.  i got burned too, then took the bargaining council guy to lunch, and he advised me on how to work within the system, and still have the the upperhand. no problems since then.
