Last I heard that coming near to the water with any type of diving equipment was sure to get you arrested or fined. Best is to ask the MCM offical at Kleinbaai slipway, they should be able to tell you what the law is.

Last year they wanted to fine a friend of mine for fishing with snowbee fishing booties, said it was diving gear. he told them to p*^%*s off diving booties dont have those thick soles and they could write the fine he will see them in court.needless to say they left without writing the fine, probably to go and harrass another innocent angler.

It is currently illegal as they banned diving from the Ratel river (past De Damme) to the east wall of Gansbaai harbour.  Thiswas because they could not police the perly poaching, and had banned commercial harvesting.  So now they have unbanned the commercial take, so hopefully they will open those areas for diving again (including inside 2 miles from Cape point so we can't shoot tail there now from a boat!!)
