Cray fish law suit

Below is an email I received from Cary (recfishserv@yahoo.com) regarding the interdict they want to serve. Please spread the word, I have already given my contribution of R300!

Hi Members and Interested Parties (Please do not distribute, Confidential information)   1.    This communication is to keep you in the loop as to how far we have got with our engagement with Fisheries re the Kreef Season. WPDSAA and RFS by written agreement are "partners" in the engagement of Fisheries as far as legal costs are involved. (50/50 Split). Originally we agreed that each party would contribute R50 000.00, totaling R100 000.00 which we were then informed wound be enough to serve an urgent interdict.

2.    However, after a consultation with Advocate Jannie v/d Merwe and our Attorney : Shaun Hangone, on 29.11.2010 they indicated the their costs would amount to about R120 000.00, that would mean R60 000.00 each. That is if we succeed in our application. If we do not we are liable for Fisheries costs which would be double: R240 000.00

 3. That being as it may b, RFS and WPDSAA have to approach there members. In WPDSAA case have more funds approved, and in the case of RFS have to raise more funds until we have at least R120 000.00 in the account. RFS cannot proceed in good faith unless we can come to the party with half of the possible costs. We are just over half way there. If we succeed in our application, happiness is! and drinks all round.

4.    The problem we are sitting with is that if you serve an urgent interdict, it be a matter of urgency. We running out of time. We have a window of opportunity until about Tuesday next week, and then a very small window of opportunity in the first week of January

5.    You may ask is it all worth it, especially spending R120 000.00 if we win and double that if we lose.. My opinion is that it is worth it, because if we let it go now, it's lost forever. This a "Milestone" opportunity We will never get it back. When the Small Scale policy is approved we will lose everything. We must make a stand now!!!!!. This is obviously my opinion. I need to know your opinion.

6.     Another development is that we had a meeting with Richard Seleke (Head of Fisheries) on 01.12.2010 re my Report to the President. He is now offering to give us Sunrise to sunset. ( See attached communication). My opinion is that he did not have Sunrise to Sunset to negaciate with in the first place as it was left out of the Gazette. We can lawfully go kreefing at night anyway. He speaks of Fisheries being irresponsible. Tking away our kreef season is the Mother of irresponsibility.

7.    If it is impossible to raise the funds for litigation, there are other options, to put immense pressure on DAFF. I will communicate this to you if this becomes necessary. I might add that RFS may be getting assistance from RFA of America, and a local company. Lets not put the horse before the cart, lets see what happens.

Kind Regards

the crayfish season has been shortened by 3 months and if we don't fight it now we will never get it back... (reduction of 60%) and this isn't for conservation, they are reassigning  the quota to commercials....

Commercials take 90%
Recreational guys 10%

now they want to increase the commercial take and reduce the recreational divers by 60%!
