Closed shad season

Hi All

I need your expert advice.  I had a disagreement with some anglers about using shad as live bait at closed season.  They were arguing that it MAY not be illegal to bait live shad at closed season as opposed to bagging it for the pan, which is illegal.  My understanding is if it is closed season one MUST release shad in anyway what so ever without inflicting harm unto it.  Any advice?

Hi Mnyamane... you would be correct in your assumptions.... The subject was discussed in the link above, however much of what is said in that thread is against the law...

The law makes NO DISTINCTION between shad destined for the table or shad used for live bait. No-one may be in possession of a shad out of season OR a shad that is undersize. Period. Anyone using Shad out of season or undersize as live bait is contravening the Marine Living Resources Act, and would be liable for prosecution if caught.

Thanx Reefman, there is absolute logic in what you just said.  One must start/begin to angle very responsibly and try to avoid confrontation with marine law enforcers.

Now my question is as follows when measuring fish - I was taught to measure to the fork in the tail on all edible fish, however the weekend some anglers caught a shad that measured 28 to the fork and 32 to the tip and when I said it was undeersized I was told no its to the tip of the tale and it is therefore size and parksboard stood about 5m and just watched

According to the stickers/rulers that the parks board handout, the tip of the tale is supposed to be used when measuring a fish. Has this method of measuring changed?

I can only find contradictionary explanations all over.

I would (to be safe) measure from nose to inside fork, then I know it cannot be wrong

[align=justify]ANNEXURE 1 SPECIES SPECIFIC REGULATIONS APPLICABLE TO HOLDERS OF TRADITIONAL COMMERCIAL LINEFISH PERMIT[/align] 1. The taxa, i.e. genus (denoted by “spp.”), family or class mentioned in this Annexure refer to all species in the genus, family or class, as the case may be.
2. The size of the fish shall be measured in a straight line from the tip of the snout to the extreme end of the tail.
3. All fish that are landed, except sharks, rays, skates and chimaeras (Class Chondrichthyes), must have head and tail intact such that it can be established whether the fish conforms to the minimum size and / or mass, provided that it may be gutted.
4. Any fish caught in contravention of the provisions of the Act or the permit conditions must immediately be returned to the sea with as little injury as possible.
5. All species in the taxon Pisces not listed in this Annexure (e.g. yellowtail) may be caught and sold in unlimited quantities by the permit holder.
6. Special note should be taken of the size, bag & area limitations with regards to kob (Argyrosomus spp.)
7. Squid may be caught for own use only and may not be sold.

Ok so to the tip of the tail if you want to keep it.

2. The size of the fish shall be measured in a straight line from the tip of the snout to the extreme end of the tail. (mmm does bending the tail down increase length)
3. All fish that are landed, except sharks, rays, skates and chimaeras (Class Chondrichthyes), must have head and tail intact such that it can be established whether the fish conforms to the minimum size and / or mass, provided that it may be gutted. ( So I can only fillet fish before I put it in the pan)
 

 

and to weight or tag the fish then according to ORI requirements and this how I have been determining my fish lengths for the pan when keeping.

so I nearly picked a fight for nothing - now come to think of it that means i have been releasing alot of size fish which I have considered undersize lol. cause there has been days where I have only caught Shad of 28cm FL and releasing them as undersize and not keeping one or two for the pan.

further more I have seen on ESPN Bass - guys squeezing tails to make them longer ???

How about this.........keep measuring and releasing in the same way....a 30cm total length shad is really not that big anyway!!

Noweeds I am going to continue doing it that way just dont want to get into argument about the correct size of a fish with some angler if he uses total length and I use fork length

I agree 30cm aint that big.....

:X...just on the topic of releasing shad!!i was fishing at winkels for garrick a while ago,when the parkies arrived and started checking sizes(shad)what really made me mad was that the two officials would find undersize shad which were swimming around in the various pools and because they are to f....ing lazy to walk to the edge of the water and release them properly they would simply throw the shad from the bricks above,the shad would bounce along the rocks and bleed in the rock pools below.....so whats the point?if the shad dies anyway!!!!!!these guys should simply be locked up!!
