New Fire-Arm Laws - New Applications

Ok, so time is running out for everyone doing renewals.

I will be a first time applicant.

But here is my scenario:

I stay on a farm, my wife and i in one house and my parents and sister in the other house. Lately i have experienced 3 attempts of break ins in one week. And a lot of drunks marching around on the farm.

I do not own a fire-arm, just a pellet gun. My dad owns a pistol, but he's a seriously ill man, so waking him up is impossible. So normally the poop hits the fan and i'm the one who has to go out, unarmed. It will take the security company too long to get here in time. Surely these buggers can outrun me, but i still have no means of imprinting in them to stay away. I have no problem to give them a proper beating with a crowbar, but we all know how it goes.

Should i attempt to apply for a fire arm and atleast be able to fire warning shots or what must i do.......

Advice would be appreciated, i have to look after my family but feels like right now i'm powerless.........

First thing, apply for your compentancy dertificate, its the part that take the longest. In the mean time you can look at firearms to buy.

For your imediate problem, you have 2 choices, go and apply for a temporary permit to have a firearm in your possesion, mine took 17 days. They will only issue this if there is enough trouble in your area and your life is in constant danger. Or you can go buy a blackpowder rewolwer, no license needed, you need to apply for a blackpowder permit wich takes a while, the longes proses will be the police clearace witch you apply for at your local cop shop, with the clearanse certificate in hand you will have your permit within a week.

I can go and do my Competency Cert immediately.

My Grandpa wants to give me his rollie, but he'll also first have to apply for relicencing..... Don't think he really wants too

best speak to the people at a gun shop, they will give you the best advice FOR YOUR AREA.

You may only discharge a firearm when property or you are in DEFINATE danger.
Discharging a firearm (warning shots) when there is no danger (the person is running away or drunk) is not a good enough reason
Scaring people with warning shots is not a good enough reason
YOU DON'T HAVE TO FIRE A WARNING SHOT to warn anybody of the fact that you have a firearm, if they attack you YOU MAY USE DEADLY FORCE
When anyone is shot a pellet gun gets handled the same as a .357 or any other firearm.

You stay on a farm, so you can use the news as motivation to get a licence, how many people have been attacked on farms.

Remember in this country you are NOT ENTITLED to own a firearm, you have to PROVE a NEED to be fortunate enough to own one.

Go do the test at the firearms dealer, and then they will tell you what to do next, they normally know who to contact and who to deal with

Get yourself ready for a long wait, but force urgency due to "attempts" on your farm !

As jou oupa nie nou her-aansoek doen vir die vuurwapen nie het jy tyd tot einde julie om aansoek te doen om die rewolwer op jou naam te registreer.

Ek sit in die selfde situasie, ek het darem toegewyde jagters status wat my toelaat om 'n jagwapen of twee meer te besit.

Maar jy het tyd tot einde julie om jou oupa se rewolwer te registreer, ek sou verseker 'n vuurwapen wou besit as ek in jou skoene was...

A word of advice Deon

if you stay on a farm and have a pellet gun WITHOUT a silencer

shoot about 30 shots every morning and another 30 every night

the sound of gunshots every morning and every afternoon (from both a spring gun and a PCP) puts wrong do-ers off, they know that the people ON THAT FARM shoot every day, so the chances of them missing is slim to none

had a friend in Brits (Nic Roets) who's wife practised with her .22 pistol on a daily basis, all the other farms had problems, but nobody dared to go onto their farm.

Want to hear a joke, I own 3 firearms, hunting etc etc,did my test, paid at the Police Station, that was in Dec 2005, came to inspect my safe bla bla, I still do not have my credit card licence. Did you see the report on lost/stolen firearms from the Police Force, over 3000 missing

you may discharge a firearm (pellet gun aswell) in a built up area if you have "good reason" to do so
but further most towns and cities have their own by-laws

target practice is a good reason IN MY OPINION, don't know about the judges opinion though.

I would strongly advise you get a firearm and start the process now!
As has been mentioned, do your competancy certificate ASAP then get the form into the SAPS (not sure where your local office is).

Then pick a handgun you're comfortable with, rollie's will do the job, but if you have the money aside, go for a semi-auto pistol rather. Something along the lines of a Glock, H&K, Taurus, Sig Sauer, Browning HP, Beretta/Z88 - basically something reliable and that you can get spares for (mags etc).

Caliber is a different matter altogether, personally, I would steer clear of 9x19 (9mm) as there is a MASSIVE ammo shortage in S.A (now worldwide). I would look at .40S&W first, plenty decent JHP ammo available pretty much everywhere. Second to that, .45ACP, steer clear of .357Sig, .38Super and other obscure calibers, as ammo is always an issue.

Gys, i cannot express the rage i am experiencing right now.
These buggers came back last night and stole one of my employee's bakkie.

They are so arrogant, they even pushed it from where it was over my parents' driveway and through the garden and off they went!!!!!!!!!!!!!!!!!!!!!!

If i could shoot them i would, but what must we do?

People have suggested paintball guns etc.

We are fearing that they'll return once again as they attempted to get into one of the other bakkies parked in the garage, my bakkie is parked right by my bedroom window.

Please, any advice will be gladly appreciated.

This has now been 4 times in one week

You are not entitled to shoot in SELF DEFENCE if you are not in danger, BUT are they armed ? Did they point "something" at you, cause if they did you are now in danger and can use LETHAL FORCE to defend yourself, it's dark, you cannot ask them if they are pointing a finger, a knife or a firearm.

Put it this way, if I break your window, climb into your house, see you and then proceed to climb out again and walk away YOU CANNOT SHOOT ME. Sad hey. You may however use the "neccessary force" to hold me there till the police arrive (by which time I would have probably died of old age).

This incident of last night CAN BE USED as motivation for a licence !!!

You CAN also shoot warning shots while they are busy stealing the vehicle, but I would not suggest that you shoot a person in the back, cause you have a split second to re-act and the police have months to analize it. Also remember that warning shots MUST NOT POSE DANGER to other people or their property.

Personally, you steal from me and I get to you, well let's just say you not gonna have lots of time to think of your crime, I will defend any person and any proterty, what comes afterwards is formalities, and I will suffer from memory loss (from the ordeal).

Another thing, IF YOU EVER INVOLVED IN A SHOOTING, YOU NEVER EVER EVER GIVE A STATEMENT IMMEDIATELY, you go get a lawyer, discuss it with him and then DO THE STATEMENT IN HIS PRESENCE - and you insist on getting a copy of the statement.

There is no law that says you have to give a statement immediately, you are actually stupid to do so because you are still in a state of shock and not thinking clearly !

Not encouraging you to take a pellet gun to a gun fight, but not telling you to take it laying down either.
I will always maintain "as die skote klap gaan hulle nie stop om te kyk hoe groot die koels is nie"

And remember, EVEN PELLETGUNS ARE LETHAL WEAPONS and CAN TAKE A LIFE, so think before you shoot.

My advice to you, go to a police station, ask them for the farm attacks/attemps/break-ins/thefts statistics for your area for the last 6 months, also YOUR CASE NUMBER FOR LAST NIGHT, use that as URGENT MOTIVATION for a firearm licence.
Licence a pump action shotgun for birdshooting and pest control on YOUR FARM and then a revolver for protection.

Convince the official at the police officer that YOUR LIFE is in danger when you apply, STATISTICS show that you are not lying, YOU NEED AN URGENT PERMIT !

only thing i can add is we used an attorney, Martin Hood i think it was...his adverts are always in the back of magnum....

he specialises in firearm applications etc etc...

my dad was denied his licenses due to lack of motivation, he got a hold of this guy and he compiled a novels worth of reasoning and motivation that they couldnt turn down!

i dont know what you'd pay but maybe its worth it if you get turned down etc....

but considering your situation and based on Neils advice you shouldnt have to wait long...

Ask Deisel if you can borrow his dogs. LOL On a serious note, I did my application on Monday. I was lucky, it only took me a hour and a half. That was just the actual application at the police station. They said it will take 18-24 months to process. There have been an up rise in crime in my area and I used that as motivation. I already have a handgun, this was just to re-apply for the licence. Your case is much more severe. Ask the cops to increase their patrols. Even if they don't do it, You have record of it. Just ask for written proof. It may help you in the future with claims etc. Good luck.
